An Augusta man pleaded guilty Monday, Jan. 10 for shooting the man who knocked his 2-year-old son to the pavement and caused significant injury to the boy.

Rodriquez A. Miller, 31, pleaded guilty in Richmond County Superior Court to two counts of aggravated assault and one weapon violation. His plea was in exchange for a probation sentence rather than jail time.

Assistant District Attorney Kevin Davis said that he recommended probation because of the provocation Miller experienced.

On Sept. 5, 2020, Miller’s 2-year-old son and another child were playing in the apartment complex where they lived and bothered Jimmy K. Hilliard. Hilliard slapped the boy, causing the child to fall face first on pavement. When Miller confronted Hilliard, Hilliard had a knife. Miller retrieved a gun and chased after Hilliard and his teenage son, the prosecutor said. Hilliard was shot in the buttocks.

Judge Ashley Wright sentenced Miller to five years on probation and ordered 30 hours of community service.

Hilliard is charged with cruelty to children. He has pleaded not guilty.
