The man accused of raping a woman working at a Columbia County massage spa back in 2016 was taken back into custody Friday for violating his bond.
Damione A. Evans, 45, had been free since a retired judge granted him an $80,000 bond July 16, 2016, on charges of rape, aggravated sodomy, robbery, aggravated battery, two counts of kidnapping and two counts of sexual battery.
Evans has pleaded not guilty in Columbia County Superior Court to all charges.
He is accused of the sexual assault of one employee at the Kings Day Spa on May 22, 2016. He is also accused of causing a second victim to suffer a brain injury.
Assistant District Attorney Natalie Paine filed a motion to revoke Evans’ bond after discovering an Atlanta Police Department report in which Evans was accused of attacking another massage spa employee in Atlanta on Oct. 26, 2021.
On Friday, Paine played the video recording that captured some of what happened back in October after Evans allegedly asked the employee to lick his feet and let him ejaculate inside of her. When she refused, he demanded his money back, and it turned physical, Paine said.
In the video, a naked Evans punched a woman several times in the face and head, and at another point he grabbed her by the throat and slammed her against a wall.
Defense attorney Paul Howard stressed that in all the years that have passed since Evans was granted bond, he has not missed a court date. Howard also argued that there was no arrest in October because, as usual, there was an argument about money, and the massage spa employees just used police to enforce payment.
Paine argued that Evans is a danger to the community, especially to spa workers who are the perfect victims because they usually are too scared to talk to the police and may be illegal residents. It was only by chance that the October report was discovered, she said, and she is now contacting all law enforcement agencies in the Atlanta region, where Evans lived, to search for other possible incidents. She said she will also seeking to have a DNA sample from Evans entered into CODIS, the DNA database which contains evidence collected from crimes, some still unsolved.
Judge Sheryl B. Jolly said that based on the video Evans, committed an aggressive physical assault on a woman and that violated the conditions of bond regardless of if he was arrested or not.
Evans was immediately taken into custody by Columbia County Sheriff’s deputies.
