Shot burglary suspect pleads guilty to lesser charge

An Augusta man shot multiple times by his ex-girlfriend’s new boyfriend was sentenced Thursday, March 31, to probation.

John K. Diaz, 32, pleaded guilty in Richmond County Superior Court to reduced charges of aggravated assault and a weapon violation in the plea agreement accepted by Judge Amanda Heath. She sentenced Diaz to seven years of probation.

Diaz was on probation at the time of the unsuccessful attempt to enter his ex-girlfriend’s home by crawling through a window on May 16, 2018. He ended up serving 18 months in prison when his probation was revoked in December 2018 after he was released from the hospital.

Diaz was shot nine times, said defense attorney Keith Johnson. Diaz lost the majority of both legs, most of his intestines and a kidney, and he’s undergone 43 surgeries since the shooting.

Diaz was charged with home invasion and burglary as well as the assault and weapon charges. He and the victim shot at each other after Diaz crawled through a window into his ex-girlfriend’s home. The other man was not wounded.
